Appendix i: FREE Trial &/or “5 Days Money-Back Guarantee”

1. The Parent or Guardian is required to give consent and fully accept the Terms & Conditions of this agreement if the student is below 18 years of age.
2. Where applicable, Free Trial &/or “5 Days Money-Back Guarantee” is provided for the student on the first lesson to assess the quality of the tutor without any obligation to continue with the same tutor.
3. The date, time, venue & fee-per-lesson of the first lesson have to be agreed upon between the tutor and the student before payment is made to the Provider. Once the “fee per lesson” has been agreed, it is Non-Negotiable and should not be changed for the first four lessons.
4. To be eligible, the student must make the first two lesson payment directly to TUTOR-SEARCH.COM before commencement of the first lesson.
5. The tutor is NOT permitted to collect on the Provider’s behalf. Failing which, 100% Money-Back Guarantee shall be Null & Void. In addition, the Provider will NOT be responsible for any dispute or refund if fees are paid directly to the tutor instead of the Provider.
6. Payment made under the student’s name & person is non-transferable to any third party or to another student.
7. Student must attend the first lesson on the date, time & venue as agreed with the tutor. Unless otherwise agreed by the tutor, first lesson fee will be deducted from the student’s payment if the student does not show up for the lesson without a valid reason.
8. After the first lesson, student has the right to discontinue without providing any reason within the first 5 Days and will get a FULL refund from the Provider. However, if tutor travel is required to the student’s venue, $20 transport reimbursement will be deducted from the 2 lesson deposit.
9. To be eligible for the FULL refund, the student must formally advise the Provider if the student decides NOT to continue with the same Tutor within 5 Days after the first lesson. The 100% Money-Back Guarantee refund policy to the student will automatically lapse after the 5th Day from the first lesson.
10. For the avoidance of doubt, if the student fails to advice the Provider within 5 days after the first lesson, it is deemed that the student will continue his or her subsequent lessons with the same tutor. In the event that the student did not attend the second or the third lesson which is applicable to Free-Trial students only, his or her two lesson deposits will be forfeited. NO refund in-part or in-full will be made to the student.
11. In the unlikely event that the tutor does not show up on the first lesson as agreed with the student, the Provider will NOT be held liable for any claims or damages suffered by the student. However, 100% FULL refund of the first deposit payment will be made to the student without any fees, charges or compensation within 30 days after the Provider’s investigation.
12. The tutor & student further agree NOT to make any claim on fees, charges or damages from either party or against the Provider.

Appendix ii: General Agreement for Student & Tutor

1. The Parent or Guardian is required to give consent and fully accept the Terms & Conditions of this agreement if the student is below 18 years of age.
2. The tutor and the student explicitly agree that the information provided to the Provider will be used for the purpose of providing a match and all its related activities at the discretion of TUTOR-SEARCH.COM.
3. The information provided by the tutor is solely at his or her discretion. The Provider does NOT guarantee that the information and documents are current, accurate or are free from any errors.
4. The Provider does NOT take any responsibilities for the tutor’s conduct, behavior or coaching methods during the tutoring assignments.
5. Tutor should have their personal identity card and qualification certificates ready on the first lesson as the student may wish to verify the tutor’s identity and credentials as communicated earlier. It is the responsibility of the student to ensure that the tutor’s credentials and qualifications are acceptable during the first lesson.
6. The Provider or the tutor does NOT guarantee improvement in the student’s grade or performance.
7. Tutor’s tutoring fees stated on the website serves only as a guide. The final tutoring Fee-Per-Lesson (inclusive of regular transport charge, if any) on the first four lessons must be agreed between the tutor and the student before the first 2 lesson payment are made to the Provider.
8. Student is to attend all lessons regularly and diligently. Student shall be punctual and should not arrive earlier (unless instructed by tutor) to avoid interrupting students who have yet to finish their lesson.
9. Unless a valid medical certificate is presented, no replacement of lesson will be provided if the student is late or absent without sufficient prior notice as determined by the tutor.
10. If a valid replacement lesson is required, the tutor is to provide alternative date & time acceptable to the student. Replacement lesson can sometimes be shorter than the usual full lesson.
11. If the tutor is providing lesson at student’s venue, the tutor is expected to be punctual. If tutor is late or unable to provide lesson on the agreed date & time due to unforeseen circumstances, the tutor should inform and provide an alternative date & time acceptable to the student as early as possible.
12. Tutor may in-advance advice the student of the day or date where lesson will not be conducted. This may include Sunday, Public Holiday or any specific day or dates. No fees should be charged for such days, unless replacement lesson is arranged.
13. Tutor may amend the tutoring terms & fees from time to time after the first four lessons which the student may choose to agree or discontinue with the tutor.
14. Frequency and payment for subsequent lessons should be made directly to the tutor. The tutor may engage TUTOR-SEARCH.COM to receive online payment from the students on the tutor’s behalf.
15. Tutor has the right not to continue to tutor the student by providing at least ONE month advance notice without reason or cause. However, fees paid to the tutor for the unused lessons must be refunded in full to the student without any compensation or interest.
16. The tutor or student shall NOT provide false or misleading information nor collaborate with one another to manipulate the Provider’s billing and commission structure. The Provider may terminate or take legal action against the tutor or student for the deliberate violation of the Terms and Conditions agreed herein.
17. The Provider will NOT be liable and will NOT act as an arbitrator or mediator for any issues or damages arising from any dispute between tutor and the student. In addition, the tutor and student are to fully indemnify the Provider of any loss or claim arising from this matching or any add-on services.
